A Level 1 EUSS adviser is permitted to complete the following EUSS applications: 

  • For EEA nationals
  • For anyone who already has a permanent residence document or evidence of indefinite leave to remain.
  • For family members of EEA nationals applying with their EU Citizen family member (excluding extended family members such as unmarried partners and other ‘dependent relatives’).
  • For durable partners and other ‘dependent relatives’ of EEA nationals - provided they have a ‘relevant document’ and there has been no material change in their circumstances – this means where the relationship between the extended family member and the EU national has already been accepted by the Home Office through the issue of an EEA residence permit to the extended family member.
  • For family members who have retained the right of residence - where they have already been issued with a permanent residence document.

Any EUSS application that does not fall within the list of examples above should be dealt with by a Level 2 accredited OISC advisor, Solicitor, Barrister or Legal Executive, this includes cases where once starting work a Level 1 OISC advisor realises that the EUSS application does not fall within their above types of permitted applications
